In regard to the fiduciary function, including the
as a branch of it the tutelary, the first thought was to
allott it to a person functionary other than the Judge: and
not to multiply beings without necessity, to one or
other of the two magisterial functionaries of a judicatory
the Pursuer General or the Defender General. In the

likely to have least business on his hands, and to whose

purpose a different manager would be necessary for each
aggregate fund: or if, owing to the simplicity of the business
in each instance case two or more might in some instances
be enjoined in the same hand, such conjunction

the maximum would be but as it was a drop in the ocean of
business of this sort that would be included in the field of
each judicatory.
