Constitutional Code

Pursue? Not he indeed. He will appear by proxy. And
this proxy who will he be? either some lawyer, or if
to sure expence a non-lawyer it will be a non-lawyer
who will of course be invested with for the purpose with
lawyers' insincerity in the most effectual appropriate state. One accomplishment
qualification he will of course be sure bring with him to an
extremity: this is the knowing nothing about the matter: knowing
at any rate nothing at all about any fact which
by from it the establishment of which the Defendants the Defendant might be made to
pay what he owes the rendering doing of justice to the pursuer
at the Defendant's expence.

Were the party on the defendant's side under any
obligation to appear in person, honest or even dishonest
he would might find some difficulty in forbearing withholding
from the pursuer and the Judge more or less of those that finds
which might be of service to the pursuer and correspondent proportional
difference to his the defender's side cause: in most cases the
defendant is acquainted with more or less of the facts belonging
to the case suit, and in many perhaps or most he
and the plaintiff are the only persons who are in possession
of this knowledge. So primative an explanation thus
primative the legislator whose care shall never have
place where it is the interest of either party one of the parties to avoid it.
Hence the reason why the wrongdoer is left at liberty to
send in his stead a men whose trade in insincerity on whom
he may depend for saying every thing that, how dishonest
so ever he might be ashamed to say himself and for himself.
