1823. Novr. 9
Constitutional Code

But now comes another master stroke.
But the another master stroke is this. When the is
thus. At this meeting be the persons who thus meet
each other who they may, are the under any obligation
to tell speak the truth? Not they indeed. From no obligation thence
opposition in necessary to justice the end thus adverse to the
actual ends of judicature, the parties no less carefully
under this French than under the English system stand
exempted.

Extraneous witnesses An extraneous witness – a description of persons who
in the suit in question may or may not be in existence and who if they appear
at all are not suffered to appear till they can not be
kept from appearance any longer far from lest by their appearance
the suit should be brought to far soon ended should too soon find
its end, their persons a person of this description it would have
been too much to exempt from so obviously necessary
an obligation: accordingly read on to Tit. pass
and there you will find that in this case in the appearance is
but one of a desire that truth may come be brought to light, and
justice consequently from thence be done.

After the who When under After those titles
having for the subject matter the judgments by from which
the cause suit receives its termination comes a title headed
with the words Des enquêtes (No. 7) and under that
head it is that for the first and only time any thing is
brought forward having for its end in view the prevention of
falshood. Under this head it is that evidence and the
mode of obtaining it are spoken of: witnesses meaning meaning such as
are not parties are spoken of and upon these the obligation
of speaking truth is required to be imposed, in the
of an oath it should serve (serment is the word) being
directed to be employed for that purpose. Well then: this professedly
obligatory
as any direction anywhere
given that it shall
be applied to the parties?
to a party on either side?
Oh no. No such thing. The suit
might then be killed as some
born, and the brush of the undertaker nipt in the bud. Accordingly by this omission by this negation and negative as it is, a licence is given for the utterance of falshood in
all shapes of which the speci multiplication of the operations and instruments paid for may be the result, and for this which purpose the same effect is given to it, such
as if they were so many established truths.
