By means of the natural
will the factitious operate.
These will be either some natural, or some factitious,
and it is by means of these those which are natural that those
which are factitious will be operating.

Probative is — to the

Useless is his being
satisfied of the existence
of the title-giving maker
of fact unless disposed he has the
desire to give to it that effect
which it was the legislator's

to it: i.e. causing the
service in question to be
rendered to the person

His being in the case in question, satisfied of the
existence of the matter of fact in question can be of no use
any further than as he is disposed to give to that same
matter of fact the effect which it was the legislature it was an
object of declared desire and correspondent endeavour to
cause to be given to it.

Proportioned to the
strength and confluency
of this desire is his
moral aptitude; to
his ability, intellectual
and active, to give effect
to it, his appropriate
intellectual and moral
aptitude.
Proportioned to the strength and confluency of this
desire is the appropriate moral aptitude, proportioned to
the ability intellectual and active is the appropriate intellectual
and moral aptitude, on the part of the Judge.

in all these its branches
has been the object of the
Constitutional Code:
in so far as regards
the Judiciary Establishment.
To secure the on the part of this functionary that
same appropriate aptitude in all its branches has been
the work object/business of the Constitutional Code: namely in that part
of it which has for its subject the Judiciary department
and establishment.
