Constitutional Code or Procedure.
To present persons persons to whom no such is due, for
making those demands of service to be rendered to them by the Judge
by exacting service at the expence of others from whom no such services are due
the law Legislator in many cases actually do as in all ought to do
– namely provides a benefit to be rendered to the defendant's side
at the charge of the pursuers side, in the event of his
as inflicting imposing vexation and expence and
vexation by a demand of a service at the expence charge of a
person from whom according to the law it is not due.
In respect of this compensation or equivalent the Defendant
in order to ere he can obtain it is must under the necessity must act the
same part and proceed on a course similar to that on which
the pursuer proceeded in the former case. To him the defendant accordingly
are now necessary means of proof and means of execution
and in so far as either are by the pursuer either are endeavoured
to be kept out of his hand, the parties change place
and the he who was at first Defendant of the former is the
is pursuer now.
