Of fraud in this shape the existence is not result of a code
accumulative of profit and loss the existence is not
merely hypothetical and ideal: to a vast extent be
it is known to have been systematically investigated
Assured Delay established by Chancery practice so many years
say five years expence of defence during that time so many hundred
pounds — say five hundred pounds: expence a hundred
a year for five years: debt contracted, for the suit in the view of the
profit to be made by this delay £4,000: interest of
at 5 per cent interest upon the that principal sum, £200
a year: net profit by the scheme £100 a year
Of the quantities here brought to view the correctness is
absolute or relative is not worth consideration:
they are for no other purpose than to aid conception
are they here employed. At the long run would not
the profit be annihilated by the compensation exacted
of the wrongdoer in the name of costs? No it would
not: for by the organisers of the scheme to wit the
Chancellor — the Ministers in Chancery and his other creators
this drawback was had been provided for. Here there was a regular
system of traffick organized by the Judge, and carried
on by them and their professional associates in the compact,
and such persons of the class as by the prospect of a share in it they
could seduce and in convert into accomplices
on the part: the aggregate profit vast: the Judges and the lawyers share
in it comparatively small but fixt certain net and pure, and of but
unalloyed by disrepute infamy howsoever in how vast so ever a degree
merited: the profit of the mercantile part of the gang indefinitely
vast, but alloyed with that infamy which, confining itself within the extent of it a narrow circle
circle, was swallowed
by them without repugnance (a)
