Constitutional Code or Procedure
Whether he can be anything else but the same
sort of hireling with a different name to him, may
be imagined from this circumstance. Into this
Court, though by an instrument called a Citation,
and may ma drag any man, yet without it,
no man can drag any man. Of the contents
of this instrument, a description is indeed given,
but the terms in which it is given, are general
terms; and for any fault in the filling up of
the boxes thus provided, nullity is provided: provided,
as well in the case of this Court, which
has peace and reconciliation for it's professed
objects, as in the sort of Court in relation to which,
no such professions are made. In a word, much
more of hardihead than of knowledge injudgment
would that man have, who, with all this instruction
before him, should take upon him
to fill up the Cavities without the assistance
of a learned person to whom it is known how
they are customarily filled up, according in to the
practice of the Court.
For greater variety, as the judicatory has two
names in the two cases, and their substitute
of the party in the one case and the substitute
or assistant of the party in the other, so has the
written instrument, by which notice is given to
the intended Defendant – that he must become so, to the
purpose of yielding fees: in the case of the inferior
Court, it is called an adjournment – adjournment:
in the case of the Court below the inferior
Court, it is called a Citation.
