Constitutional Code or Procedure
On this occasion care should be taken by opinion
not to be exclusively governed by the two generic names.
To no small extent the motive apt to capable of being employed in penal non penal
law and non-penal procedure is to an indefinite degree more
drastic than that ordinarily employed in penal procedure. By the
burthen of compensation the whole of a mans property pecuniary means is
frequently taken from him: whereas where in so far as
as ablation of pecuniary means is employed in the
character and name and for the purpose of punishment,
it is with to a remote extent, fixt and thereby
limited: fixt at sums sinking as low as the value of
day labourers days labour and seldom may be as
so high as say £1,000 of the multiplicates the multiplicates of which
by not a thousandth part of the mass of property
which in England has in no small number of instances has
been exemplified.
As far as this is the case on the part of a Defendant
greater reluctance to forthcomingness of person and property, particularly
of property, and of person on account of change to
property has place, and requires to be overcome, in
non penal than in penal cases.
