1825 Jan. 19. Require that a commissioned proxy produce his commission

§. For pursuer, proxy has for in what cases admissible.

At. 1. Exception excepted, the only person on whose appearance at whose instance
a brief summation can
a suit can be commenced against any other is the person for
whose benefit the service of the Judge is demanded at the expence
of the party so sued.

Art. 2. Exceptions are as follows

1. Whether for termination or termination to prevent or terminate in every sustained or otherwise
about to be sustained by the party a certain party in question, a person
without authority from the party appears and on behalf on the score of
through concern sympathy makes the demand.

In this case the following are the conditions the Judge if he sure right may entertain the
suit and after appropriate examination of the applicant issue the requisite summation or prehension warrant
the case may require.

1. If it appe to his satisfaction it appear, that in case
of damage, either to the intended defendant in the suit, or the to the
pursuer self constituted spontaneous substitute, should the thus proposed to be constituted pursuer
the applicant is in such sort effectually responsible that the requisite instrument may be issued, without preponderant
danger.

2. If it moreover appears either that either the proposed pursuer
is either ignorant of the fact wrong done, or that if he is not altogether
ignorant he forbears such appearing to and giving commencement
for want of sufficient consideration, under which in such a
state of things in which for want want of promptitude the means
of obtaining remedy may be probably lost.
