§. Insecurity producible by liable to result from the admission necessarily given to
Substitutes obviated
By a man who is conscious of being in the
wrong, the employing a substitute to act acting by substitute in his stead
is a resource which in so far as possible will be
affords an advantage which in as far as possible
can never fail to be employed: for For by this means
the party escape withdraws himself from the scrutiny
of examination: he avoids the obligation of confessing admitting
such facts of if admitted, and if confessing such facts as if confessed would make against him.
From him such con admission and confession can
not be had: for he is not there present to be called upon
for them: from the substitute they can not be had,
for the party has taken care not to communicate
them spontaneously, and the substitute not to act
for them.
From these considerations results Then comes the demand for arrangements to some
such effect as the following.
