1824 Feb. 15 § 5
Procedure Leading Principles First Lines
Art. 1. Where the applicant is a substitute
applying on behalf another person, it will be among
the cares of the Judge so to order matter that from by
that such substitution as little prejudice as little as possible
to justice be produced.
Art. He will accordingly consider whether
the case in question be among the cases in which
such substitution is either unavoidable, or made
to no other purpose than that of saving delay, vexation
and expence.
Art. For the purpose of obtaining on one
future occasion they if needful any such admission
and confession as the substitute could no principal party
might but have made though the substitute could notmake, he will
reserve to himself, and declare his reserving to himself
the faculty of examining the party in person
if now and whensoever the obstacle to his attendance in person
shall have been removed.
Art. With a view of detecting any insincerity
suspected by him to have had place in the testimony declaration
of the Substitute, the Judge will if necessary needed
examine the Substitute at the time loading such the intercourse
oral and epistolary that as had place on in relation to the
subject between him and the his principal the party: and eventually
he will moreover thereafter examine the party
himself in relation to such intercourse. On this occasion He will
after the examination of the Substitute by himself, either examine
them and the party his principal together in the way of
confrontation in the
first instance, who
in the first place examines
the party separately, and
thereafter examine him
and the substitute given
in the way of confrontation.
