Art. Exceptions excepted, in the oral mode
will the examination of every examinee, whether party
or extraneous witness be performed.

Reasons 1. Because as compared with the epistolary the oral mode is the mode
most conducive to the direct end of justice. As to this See Ch.

Art. The exceptions are Exception is where the epistolary
mode is not only most conducive to the collateral
ends end of justice, to wit minimization of delay vexation
and expence but in such degree more conducive,
that the evil from the encrease excess in respect of
delay vexation and expence on the occasion appears of a nature likely to outweigh
the evil from the unfavourable influence in relation
to the direct ends of justice in the other case, added to
the incidental evil of detriment to the direct end of justice,
by that deposition of evidence of which delay is liable
to be productive.

Art. What may happen is – that the fixed
habitation settled or at the time in question, occasional if examining in any
number may be in the territories of so many different judicatories.
In such a case of this sort forasmuch as it is only in
some one judicatory that the suit can receive its termination
the one in which primâ facie it may most aptly
receive its termination is the originating judicatory.
