§. Applicants who
On In the present occasion instance, at the time in the case of an
application made by one person for the benefit of another, at
the instant of the application made no although no such by the application
a party for whose benefit the application is made has place
that is say for shortness an intended benefitee, yet no such
person as a trustee, nor any such person as a trustor as
yet has place. True. But no sooner does the Judge entertain
the application and commence giving effect to it, then
the two gaps are, both of them, filled up: by the Judge, he
being authorized by the Sovereign, the applicant is constituted
trustee: the party for whose benefit the application is
made being in the character thus proposed to be given to him,
confirmed and established.
