§.
Art. 9. Howsoever exempted as above from attendance
in the first instance no person who in consequence of attendance
paid by a substitute has been received in the character
of a pursuer can ultimately receive the service prayed
by his suit until the suit unless if so required on the part of
a Defendant, he has undergone examination locating the
matter of the suit, in presence of the such Defendant, at the
Judicatory in which the suit commenced, or the care of
that same Judicatory in at some other Immediate Judicatory
of the State: unless from apt and sufficient evidence
it has been ascertained that whatsoever be his
interest in the cause no facts of any such nature a nature as to serve
the defendant's side of the suit can have come to his
personal knowledge.
Art. 10. Whosoever attends instead and on behalf of a pursuer
a person interested to pursue as above, is examinable and responsible and examinable
in the same manner and degree as the pursuer himself
would have been had he by attended.
Art. 11. Until the party interested attends and recognizes
himself as per to be pursuer, the suit bears the name
of proxy and principal united.
