Constitutional Code

Art. 16. In If a case of a suit which at the commencement
of it requires temporary secrecy as a necessary condition an an indispensable means
of
to the giving executive and effect to it, the party in
attendance for that purpose gives intimation thereof by a
folded ticket delivered handed over in public to the Judge. The Judge
thereupon when at leisure withdraws into an adjacent closet
or taking with him the Registrar and the attendant suitor
by whom secrecy is requested, as above.

Art. 17. Occasions The An occasion on which such temporary secrecy
may be requisite as above are is where the prehension of
some individual person or thing for evidence or justiciability in the character of a party or an extraneous
witness being or an agent or servant of a party being necessary
as above, sufficient ground has place for apprehending
that of the declaration made by the pursuer were
made in public, the party proposed to be prehended
receives information time enough to evade make his escape
withdraw the person or thing out of reach the reach of the prehending functionary.

Art. 18. The suit being thus commenced, it will
in the ordinary state of things be the desire of the party on
the pursuers side to meet the party on the Defendants
side in the presence of the Judge as soon as may be
but whether it be the pursuers or no, such will be desire and
endeavour of the Judge. For this purpose he will issue either
a summons directed to the Defendant, or a warrant for his
prehension directed to some other person, as the case may
