as the only proper end of government
happiness of the greatest number — proportioned to the strength of their assurance
will, I trust, be the force of the inducements by which you will be
moved to give to the work your acceptance and support: proportioned to its actual conduciveness
to that same great end, will be the facility attendant on such
endeavours as shall be employed in obtaining for it at the hands of the people a general and ultimate
acceptance.
Of this proposed Code a distinctive character would be — No arrangement
without its reasons: no arrangement to which were not subjoined an
accompaniment, indicative of the considerations which in the character of
reasons, had had the effect of recommending it to the choice of the Draughtsman,
and which in so far as it were adopted, would afford to all persons
concerned in giving adoption to it their justification; to all persons, whose
obedience it called for, a source of satisfaction; , for the exclusion of doubt,
in the first place to the Citizen subject as such, in the next place to the Judge
as such, a source of interpretation; and, for giving consistency to these reasons,
all along will indication be afforded of their connection with each other, and
of their subserviency to the abovementioned great common end. Permitt me,
Sir, on this occasion, to present to your notice a simple truth. An all-comprehensive
Code of law, with the Rationale of it for a continual accompaniment
to it — never, since law has been in existence, never till now has a work
of this description been any where presented to the world.
As to the Testimonials in question —
1. In the first place, you will find some from the Government of
Spain. See A1. A2. A3. A4.
2. In the next place, comes one from the Government of Portugal: incompleat
indeed, but as near in its advance towards completion as the state of that Government,
coupled with an unfortunate miscarriage of communication, admitted of The man,
the extract from whose letter you will see, (Letter B.) is represented to me as
being the most influential man in the new Regency of that regenerated
Kingdom. While I am writing, comes advice of a sort of completion, (B.2) given to it by the Cortes.
3. In the third place, some from various Governments and distinguished
Functionaries of the Anglo-American United States. For these I must beg leave to
refer you to an already published work of mine, intituled "Papers on Codification."

4. Letter to me from Alexander Emperor of Russia. For this the same reference
