Cæmenting
Principle

That consideration || || circumstance which determines a set of legal propositions
to be put + +made to stand together into one [and the same]
instrument, rather than apart into different
ones I call the cæmenting principle.

How many.

The cæmenting principles which I have
seen reason to adopt, are these three [in number.]
1st Identity of object. 2dly Identity of
subject. 3dly Identity of End.

1 Object

The object of a Law is the person to whom
the precept of it is addressed. The sort of person that in the agent
in the sort of action which it prohibits
or commands.

2 Subject

The subject + + material subject of a Law is the sort of thing || || substance
on which the sort of action in question is exerted.

3. End.

5.
The end of the Law is the sort of Good
which it is intended to produce. The sort of
pain which it is calculated to avert: by
causing the sorts of action calculated to produce
that sort of pain not to be done.
or the sort of pleasure it is calculated
to give rise to: by causing the sorts of action
calculated to produce that sort of
pleasure to be done.

6.
What constitutes the identity of the mixed
mode
called a Law.

7.
What constitutes the identity of the substance
called a legal Instrument.

A Law is compleat when 1st the sort of action it
concerns is compleatly described and the compleatly expressed prohibits or commands

precept directory part and Sanction it is composed of are
compleat. The directory part when if a prohibitive
is compleat when the action prohibited
being done the Sanction is to be applied is compleatly described. The action
in all prohibited is compleatly described, when the
Sanction [ in question annexed to it] is meant invariably to
be applied in all cases that are not expressly excepted.
