DEFINITIONS

LARCENY
Is the wilful taking of the moveable property of another by one who does
conceive it to belong to him. a person who steals his own goods with intent to charge cestuy que garde? If he means to steal one thing & has taken another? & who has no reason to presume the consent of the owner.

ROBBERY
Is the wilful taking of the moveable property of another by one who does
not conceive it to belong to him with threats exprest by words or gestures to se
person of bodily harm in particular or such as should be to oppress in general

BURGLARY
Is the being in a dwelling-place with intent between ... at night and
in the morning with intent to kill maim disfigure ravish a person or take
destroy property by one not conceiving himself to have a title by Law so to do, nor having
any reason to presume the consent of the owner

MALICIOUS MISCHIEF is {with force without force} analogous to Larceny & Robbery
v. Notoriety 2. ad dors.

MALICIOUS MISCHIEF without force is the destruction or damaging or abjection casting away of the property of another
of on [malicious] purpose by one [who does] not conceiving himself to have a Title by
Law so to do: nor has reason to presume the consent of the owner.

MALICIOUS MISCHIEF with force is the destruction or damaging of the property of man another
of [malicious] purpose by one not conceiving himself to have a Title by Law so
to do with threats exprest by words or gestures to some person in particular or to such as should be offences in general of bodily harm

PIRACY To determine in what cases offences committed abroad should be punished at home & in what be left to the Jurisdiction of the country? v. MS. 4th IV. §.4 is any of those offences committed on the High Seas or out of
England by persons landing out of a Ship for that purpose.

HOMICIDE Killing where CRIMINAL is either MURDER MANSLAUGHTER or
by NEGLIGENCE2 or by ACCIDENT1

MURDER is the causing of the Death of another in pursuance of an intention
conceived without any provocation or from a provocation of old-standing to kill maim or disfigure the person
slain or another# # In case of killing one when another was intended the questions of exemption must apply to that other. Qn? when such aggressor kills one where he been assaulted in self-defence be Homicide.

MANSLAUGHTER is the causing of the Death of another in pursuance of an
intention conceived upon a sudden provocation to kill maim or disfigure the pa person
slain or another# # In case of killing one when another was intended the questions of exemption must apply to that other. Qn? when such aggressor kills one where he been assaulted in self-defence be Homicide. upon a sudden provocation returned after a provocation offer'd past offer'd by the Slayer or it is the causing the Death of another in pursuance of an a sudden intention concerned

HOMICIDE by NEGLIGENCE is where a person without intending to he
murder disfigure ravish [or disable] to any one kills a person for want of due care.

HOMICIDE CULPABLE by ACCIDENT is where a person with after or without provocation
another intending to do him or some one else some bodily hurt but not to kill maim or disfigure the person or another
