therefore does not of itself fill up produce entirely that measure quantity of guilt which is
exclusive of salvation: but I find it contributes more than I could have
thought of it to swell it – it contributes more than Murder. Such an one
has used me ill: let me abstain scrupously from swearing, & without forfeiting
my pretensions to the divine favor I may be satisfy my revenge – I am poor
such an one has in such a place a Sum that would make me happy: Now
if swearing is worse than Murder, much worse is it than theft – let me If I am

Felony without Clergy – Very well, be it is – class in Felony without Clergy.
Another Crime is proposed - What's to be done with this? Done, oh, we must have a severe punishment
for it, or we do nothing – What Felony without Clergy? Viz, there that's rather too much – what's
the next? Single Felony – Very well – be it single Felony then – class in Felony, & say nothing
about the Clergy. This is what it has been hitherto to make Laws – The Men's deliberations according
to the present System admitt of no further nicety – It saves a world of trouble. Meantime
either of these sort of punishments consists of one knows not how many sorts of punishment, of which
no one perhaps has any thing to do to with another, & to the nature & extent consequence of which more
than one half of those who vote for them are utter strangers – No matter – it is no nothing more than usual,
and therefore no nothing more than right.

If regulation has been made within this year or two, highly laudable, & well calculated to give the appearance of solemnity to deliberations, whereof the subject is so serious: no clause in a Bill imparting capital
Punishment is to be debated but in a committee of the whole House.

But it is not the number alone of those who are to judge that will give [solidity] to the judgement,
but the principles they pursue.
