Had the Judges – the manufacturers of the rule of
action in this and most other parts of the field of action found been
themselves left at perfect liberty in this respect, they would
have life to such inculpative facts, arguments, censure
and complaints so derided a considerable degree of liberty.
For of every man on condition of proving the truth of his
charge or at least a probable cause for making it, were
allowed to proffer bring forward and circulate those charges, all those who some reason flattered
them to hope some sufficient reason to hope that such justification
would not be capable of being proved, would naturally
be disposed to such redress at law, and thus afford by
so much the more business to that partnership of which
the Judges were at the head: and whether the matter of justification
was proved or not proved, so the suit the source of their profit began and
ran out its course was to them a matter of indifference.
But here the interest of the King and of head, as well as the other
members of the government stood opposed to theirs: and
being in a state of absolute dependence on the King, liable
to be turned out by him at pleasure, it was matter
of necessity to them to give up this part of their profits
was matter of necessity.
Moreover they themselves constituted composed a part, and
that a very principal part of the whole number of the
members of the government: and consequently it concerned their own security and the preservation of the whole mass of their profit all
complaints, concerns, and inculpative facts and arguments
by which
their own conduct for their object should be
suppressed with still more unrelenting severity and vigilance.
