Of Unlawful Defamation.
Practices on the score of some general qualities that are imputed to him.
4. Acts or practices which expose a man to aversion
or contempt are either, 1. Acts or Practices prohibited
by the Law: or 2. Other disreputable Acts or Practices
at large.
5. Acts or Practices prohibited by the Law are either
1. First-rate Crimes. 2. Second-rate crimes. 3. Misdemeanours.

Justification
1. Defamation shall not be punishable,
Where the matter of fact is true: except in
the case of certain offences, and other disreputable practices,
consisting in the abuse of the venereal appetite: to wit,
1. Adultery. 2. Simple fornication. 3. Seduction. 4. Incest.
Incestuous Seduction. 6. Abortion. 7. Unnatural Impurities.
Unless where the party had before the Defamation
been convicted of the fact in question, is (or in) course of Law.
2. But the burthen of Proof lies upon the Defamer
