3. He may be fined. 4. Fine. This at option: & at discretion.
5. If the offence be trivial, the Offender may be discharged
from all punishment and the burthen of costs on both sides may
be distributed at the discretion of the Judge.
Exposition – Explanations.
[(A) Enormity] The Offence is more or less enormous,
1. According to the Intensity, Duration and Extent of the
aversion or contempt to which the party defamed is
likely to stand exposed in consequence of the Defamation.
2. When the Defamation was private and communicated
to any one person or persons in particular
according as it were more or less material to the
party defamed to stand well in the esteem and good-will
of such person or persons. 3. According as
the party had more or less opportunity given him of
defending himself.
