Of Unlawful Defamation.
Aggravations. I. Intention of Special Damage
occasioning any special damage.
Extra-punishment.
In such Case if the Offender does not make full and
adequate amends he may be punished in the way of
Retaliation.
Exposition.
[Special damage] Vide supra [Reputation] Art.
[Retaliation] Retaliation is meant in this case causing
the Offender to suffer as near as may be the same
damage which he brought or endeavoured to bring upon
the party injured. See Tit: [Irreparable personal

Tit. [Unlawful Confinement] voce [Retaliation] Art.
Aggravation II. Contrivance
Where the offence is accompanied with fraudulent subtlety of artifice or contrivance.
Exposition.
[Fraudulent Artifice Contrivance] For instance where the defamer in
order to gain credit for his insinuations prepares the way with
professions of friendship for the party defamed, or takes any artful
