Aggravation III. Combination Confederacy Conspiracy
Where several Offenders conspire together to contrive or
spread the Defamation.
Extra-punishment – Characteristic penance the Conspirators
In such case they may be made to do penance in a manner
more or less public by being ignominiously yoked together. This at option: and as to the mode, there is times, place or places
at discretion.
Other Aggravations are, 1. Superiority of the party injured
in point of natural domestic relationship. 2. In point
of conventional domestic relationship. See Tit. [Justifications] [Simp. pers. corp. Injuries].

1. Innocence of Intention. 1. Intention innocent, and part of blame. Where the offender upon probable
grounds (A) believed the imputation to be true: or that, true or
not it would not be prejudicial.
Abatement or Infra-punishment
In such case he shall not be punished more severely
than by asking pardon: with or without or expression of regret costs to be distributed
at discretion.
Exposition
[(A) Probable grounds] 1. The probability of the ground a man
has for propagating a defamatory report which turns out to be
