2. This Excuse Extenuation is the more or less valid inversely in proportion
to the degree of confidence with which the notion was advanced. See Tit. [Simp. falshood] verbo [Belief] The more confidently it was is advanced by him the stronger
might the grounds he rest goes upon to be in order to serve him
for as an excuse extenuation.
3. If the offender cannot make it appear that he took
the report from some other person, the presumption is that
he was the author.
4. A man makes himself the author of a report in proportion
as he adds, alters or omits any material circumstance,
or adds materially to the degree of confidence with
which it was advanced by the person from whom he had it.
