Penal Code

Of The political sanction the power is by the supposition
compleatly in the hands of rulers, that of the religious sanction
is so too (how much so ever to be regretted this is not
the less true) in so far as it is applicable applies to this case. Remains
the popular or moral sanction as the only moral force
by which any check can be applied to abuse of power
be it ever so enormous in the hands of rulers. But this
force of the popular or moral sanction it is only by the
sort of imputation in question that in the very nature of
the case it is possible to bring it into action, and make
application of it to this purpose.

In so far as the conduct of rulers is exempt from
the imputation of misrule, the moral sanction so far from
being against it, operates acts in support of it with all its
force. Only in so far as the imputati upon enquiry
the imputations are found imf proven turn out to be well grounded, only
in so far as the conduct of rulers is found to be justly
taxable chargeable with misrule, have they any thing to fear
from it. When therefore a man is contending for
the power of punishing and suppressing all such imputation ill
grounded and well grounded together what is it that
he is contending for? What but an unlimited
licence for the enjoyment of the pleasure and profit
of misrule – of misrule in all its shapes: and to in
what design what can add>purpose</add> can he be thus contending for the faculty
of producing unbounded mischief exercising unbounded tyranny, but in the design of exercising
it.
