Penal Code.

In support of the practice of punishing political defamation
in every shape – in support of the system of punishing
ad libitum for every discourse which on the part breasts of those in
whose hands is the power of punishing, shall have excited a
sentiment of displeasure a desire of giving exercise to that
power. English law has given birth
to a practice rule and that rule adopted by the constituted authorities
which it may be of no small use to other states to see placed in a clear light as well as correct light point of view
by viz. that in this case so far from being a justification
is an aggravation.

To a first view a position of considering the quarter from which it secures in which it finds its support to this effect is apt in every
honest breast to give birth to so excruciating a sensation – it
has so much an air of despotism in a breast of the
most com profligate nature worked up to a state of madness
that an exposure of the ground it which in the field of real
the principle of utility argument it stands upon for of such a ground it will be
seen to be not altogether destitute – may here be not without
its use.

That, the matter of the accusation being in respect of its
gravity the same in both cases the same man suffers
much more from it in the case in which it is true
than in the case in which it is false is matter of universal
experience. How should it be otherwise? Be the
fact what it will, the probability of its being believed that the assertion by which its existence is affirmed with is much
greater where that assertion is true, than where that same
assertion is false: much less where that asme assertion is false
than where it that same assertion is true. With
