Penal Code

When the assertion by which misconduct is charged upon a man is
false, the further the enquiry is pushed the greater the probability he
sees that the falsity of it will be brought to light and universally
acknowledged, but when an assertion of that sort is true the
further the enquiry is pushed, the greater the probability that
the truth of it will in like manner be acknowledged. By in
a word by a true accusation much more is a man alarmed intense is the alarm
than by a false one to the same effect. Who can doubt of this?
But the greater more intense his alarm the greater more intense his sufferances.

This correct in the observable But on what principle on the occasion in question
is it pertinent, and in such sort pertinent instead of affording matter of falsification as to present
a demand for the aggravation of the punishment?

It is on this principle: viz – that on this occasion into the
account of evil, the pain of mind sustained by the person
to whom the misconduct is suspected as the only claim element
that has any claim to be admitted.

As to the men in power evil capable man in power
the man to whom misconduct is imputed, it is not in the
nature of the case that by to his conduct any thing of the nature of evil any thing of that sort can
justly be imputed. But by the imputation where cast upon
him real evil is produced viz. the pain of mind such as which has
place in his breast. But this being the only evil, the evil produced by the offence, and no good in any shape produced by it, the greater this
evil the greater the quantity of evil which in the shape of
punishment it may be requisite and necessary to employ
for the exclusion of it.
