2. Jury trial Compared with this use instance, in other instances Jury trial is
of little importance.
As far as any thing can be made by such an instance agent
as far as the imaginary product can be created made by an imaginary hand,
that part of the Penal Code which regards political
defamation has in England been made by Common Law.
This By Common Law – that is by the of the Monarch
the till lately arbitrarily displaceable and still arbitrarily placeable are
placed of the Monarch in the character of Judges.
Under the this Common Law liberty of political defamation – liberty of
uttering without being punished for it any thing that when
published it shall please the Monarch and or his instruments
not to like and to such a degree not to like as to cause
men to be punished for it – any such liberty by law has no
more place in England than in Spain or in Morocco.
On a prosecution of this sort, the Judge tells the Jury whether
the publication thus given to the discourse in question is a
crime or no. In thus affording his protection to every other
member of the governing body against exposure of their misdeeds
how mischievous so ever, he at the causeaffords to himself, and
the with what he is in a community
of sinister interest. Since the commencement of the present
reign already fifty eight years ago – since this time not to go
higher, as in no time has the Monarchs prosecutor servant
the Attorney General informed the Jury that the polit publication
in question is a crime but the Ju an assurance to the
same effect has been given them by the Judge. In no instance
has this useful assurance ever yet failed to be given: in no
instance so long as Monarchy stands unreformed will it
ever be gi fail to be given.
