Penal Code
Where this plea is maintained, the support given to
it consists either in a direct assertion, or in a sort of
circumstantial evidence.
The direct assertion is the assertion of the alledged fact.
But this being a naked assertion, a mere deemed assertion of the
thing in dispute, is destitute of all probative force.
The circumstantial evidence, the only sort of
evidence which the nature of the case admitts of consists
in the magnitude of the demand punishment demanded
which by the supposed party supposed to be injured, it is required
should to be inflicted on the author of the injury.
But the magnitude of this demand what does it prove?
It proves at the same time the vindictiveness of his character frame of mind disposition.
It proves the sensibility degree in which the different
laws diminish even him. To give allowance to
this plan, and the punishment accordingly
would be to give hold out a precedent to cruelty. The more greater the quantity of evil
you require shall be inflicted on the party to whom on this
accent you bear enmity, that the greater the quantity
which you shall accordingly have the pleasure of seeing
inflicted.
