Penal Code
To the prejudice of the mans character of him who pleads
it this plea operates on a double account: 1 by as a proof
of general depravity, as just mentioned, and as a proof evidence of the
truth of the imputation, in the manner above brought to
view. As conclusive evidence as in the any character it
can not operate. Because what may happen is that the imputation may is notoriously
false: and still this sort of circumstantial evidence
of its truth may have place. But though as in the character
of evidence of misconduct in the individual shape
imputed of misconduct committed on the individual occasion
in question, it is its protective force is destroyed transferred
by counter evidence, in the character of exis circumstantial
evidence of the misconduct in other instances as yet
unliquidated it does operate. The more evil a man
has done, the greater his fear is of seeing it proceed. The
more greater the merits of offences misdeeds a man has committed
and the greater the enormity of those several misdeeds, the
greater the fear approbation he is under of seeing some of them
proved, the stronger the general line stream of his appearances habitual sensibility of his mind in this sense
and the more apt it is to be excited by any individual
incident by which on any individual account the
general mass of evil that hangs over his head is
brought before his eyes.
