Examples of Cases of homicide in which the Slayee

1. Case of a Slave-ship in which the deaths have
been produced by the multitude greatness of the number of the individuals crowded
together in the same receptacle.

The persons instrumental in the production of them In regard to these deaths the acts by which they are produced
deaths ought should stand upon the same footing as if the
same individuals had been separately attacked and
by being stabbed or shot: with only this difference then in
the case of stabbing or shooting the death may be instantaneous,
whereas when it is the result of disease produced by heatv excessive heat and an infected atmosphere it is preceded
by a more or less protracted course of extreme suffering.

Immediately Acting Principal in this case the commander of the vessel
Originating Principal, the owner or of the vessel individual or in case of partnership
the individuals by whom whether these are property, or
hired the vessel was fitted out for this purpose.

Of the persons whose death is to be ascribed to
the Commander difference or Freighters or whoever was concerned in determining
the number of the slaves stowed in the vessel the number
will be the excess over and above the number of the persons of the same age who
on a voyage of the same length generally die natural in the country
from whence the slaves were taken. This standard number not
being capable of being determined by actual observation, it will have
on the part of the Legislator the necessity of assuming for the purpose a standard number
by conjecture. Say for example Number of slaves confined in the
vessel in question by observation 400: No. dead in the course of the voyage, 100: assum
No. who would have died in the vessel in the course of the same voyage, had
the vessel had its ordinary complement, crew and passengers taken together, – 2.
Remains as the number of those whose deaths may with propriety be imputed
to the persons concerned
in determining the number
