Law Amendments or Penal Code
Causes capable of producing a bonâ fide retardation: viz
on the part of the Plaintiff
1. The Collative event unknown to him
2. A necessary evidence of the Collative event unknown to him
3. A necessary evidence of the Collative Event, though known to him,
not known not to be fr not forthcoming.
Cause capable of producing a mala fide retardation
by mala fides on the part of the plaintiff.
1. On the part of the plaintiff Knowledge of the existence of evidence favorable to the defendant:
waiting for its deposition or nonforthcomingness
2. On the part of the by mala fides on the part of the Defendant
1. The Defendant has kept concealed from the knowledge of
the Plaintiff the knowledge of a crime which to the Plaintiff is
a colative, to the Defendant an ablutive event
2. – or a piece of evidence probative of a collative or
disputative of an ablative
Fixt times ensure success to mala fides in every
instance in which it has place.
Remedy 1. Conjunct examination of parties will elicit and defeat
mala fides in which one side existing.
Receipt of Application by plaintiff with power to stay proceeding
till the nonforthcoming evidence be forthcoming will preserve
the demand from being antiquated by nonforthcomingness of evidence
Remedy 2. Division of the compensation money in any apt proportion
between wrongee and wronger.
