Here then is the course taken in the pronouncing of
the series of those decisions – here is a principle
that may be said to be pursued. What Of this principle
what shall be the name? Call it the principle of
imitation
– or for shortness the imitation principle.

The course taken by the Judge of the in Judge
made law has its emblem and its prototype in
the course taken by the Astrologer. The Astrologer
points his instrument to the region of the stars and planets
and pretends to read reads in it the fate of the individual
who comes to him for his opinion on it. The Judge
points his instrument to the region of the Law Reports, and
reads in it the fate of the man which has been
before him. The instrument of the Astrologer is the
telescope – a real entity: the instrument of the Judge
is a fictitious entity – the imitation principle. By Per
the supposition the case being an entirely new one
the state of things in general being the only one instance of the
sort that has ever occurred of the sort it belongs to
has never yet presented itself to the mind of any
Judge: no matter, for the purpose of the decision about
to be pronounced, it must be feigned to have been in the
minds of some if not all anterior Judges: for according to the fiction
the decision about to the pronounced is part and parcel
of the law – of an aggregate already in existence.

The Astrologer has empl in addressing himself
to his informer has employs a particular jargon of his
own invention: object of it purpose of it the appear being
regarded as know in a peculiar way and degree knowing

jargon of his own, purpose of it the same as that of the Astrologer
that is to say the intermediate purpose: so likewise the ultimate
