Penal Code Offences against Condition

Wrongful Dissipation in prejudice of Wardship is where
with relation to a certain person Ward considered in the character
of a Ward in the hands of a Guardian
but without Peculation, is where
without necessity(1) money or moneys worth belonging which belongs
to the Ward, and ought not to be employed but
in the shape of capital, is exposed compl though to the use of the ward expended
in the shape of income.

Expositive

(1) [Without necessity] Necessity in this case is
either absolute or relative.

Expenditure of Absolute necessity is such that without the which
the individual would perish with hunger, or contract
some incurable or permanent disease.

Expenditure of relative necessity is wher that
without which the ultimate interest of the Ward would be
sustain greater detriment than it would sustain
from the amount of the dissipation.

If for example. In the course of his education
he is in the for example he is being in the way
of acquiring certain profitable or otherwise useful talents, or in in possession
or has reasonable expectation expectancy of certain connections
affording a promise hope of pecuniary benefit
in a pecuniary or quasi-pecuniary shape
upon his arrival a mature full age, his property
without blame on the part of the Guardian sustains
a loss: in such case rather than that the acquisition
of those talents should be prevented, or the chance of those connections
broken, it may be conducive to the his ultimate interest, that
the consumption expenditure of
capital to a certain
amount upon those objects should take
place.
