Penal Code Offences against Condition
Peculation in prejudice of Wardship is where
to the loss of the Ward, the Guardian makes undue
by mismanagement in the management of the property of the Ward
makes undue(1) profit to himself.
(1) [Undue] It may be that by virtue of the his instrument
of Contract by which the person is appointed Guardian,
or by direct appointment of law the Guardian
may has been allowed to take to himself in remuneration
for his services in that capacity profit
in this or that shape to this or that amount out of the property of the Ward.
In this case the profit so though taken its expence, and
in that view to the loss of the Ward is of course
not undue.
