§. 1. Wrongful non collation
Servantship
1. Wrongful non-collation of Servantship is where with relation to a
certain person considered in the character of a Master, another
person would in the event of a certain act's being one
by a certain other third person (the delinquent) or by a certain
other number of persons of whom the delinquent is one,
have had legal possession( ) of the condition of a Servant
the delinquent being bound by law(1) to conferr or join in
the conferring in the person such second person in question such condition
has omitted so to do.

Of these two correlative offences the one The one offence can not be committed but the other
is also committed at the same time: but of these
conjunct offences the consequences may be regarded as
injurious to the one of the two parties or to the other,
or to both: and for the application of remedies of the satisfactive cast a demand may
have place for the benefit of the one, or of the other or
of both.
