Offences against Condition
4. Wrongful non-Collation Usurpation of Servantship is where in relation
to a certain person, considered in the character of a Servant Master
another person, viz. the delinquent, without legal title but
under the notion or pretence of his having such title,
takes upon him to himself to act in the character of
Servant, exercising in a greater or less proportion the
powers attached to that condition by law in relation to
such his supposed master or to any of his effects(1) of his
the power attached in his own or other instances is capable of being attached by law to that such
assumed condition by law, or has caused or contributed to
cause himself to be, by law, or in effect, regarded
and dealt with as being in rightful possession of such
Servantship.
(1) [Effects] On pretence of being servant to a certain
person considered in the character of a Master, the delinquent,
suppose, without consent or against the will of
the such supposed Master, sells certain or lends, or lets out
certain goods of such supposed Master. In this case
if on the part of occasion of this offence the pretended Servant criminal
consciousness has place the offence may be an act
of Theft or Fraudulent obtainment: or in case of
non alienation an act of usurpation of property
with or without blame, according as mischief
had or had never or was not plain in the his case.
