Offences against Condition
5. Wrongful non- Collation of Servantship is where with
relation to a certain person considered in the character of a
Master, a certain person (the delinquent) by some wrongful
act, positive or negative, causes or contributes or endeavours
to cause a certain other person, who, with relation to a
third person this supposed Servant) such supposed Master is not in rightful
possession(1) of the character condition of Servant to act as if he
were or in effect ought to be, by law or in effect, regarded
and dealt with as being in rightful possession(1) of
such Servantship.
(1) [In rightful possession] in the falsely assumed character of
a Servant to the person in question suppose another person
as above to dispose of any effects of his. If on the part on the occasion
if there appear of such self-pretended Servant, criminal consciousness
has had place, the author the delinquent of such theft or fraudulent obtainment
may have had for an accomplice another person
acting in the character of the Wrongful collator of such Servantship entitled to confer, and
conferring accordingly the Servantship here in question.
