8 Wrongful non-Collation Interception of Guardianship is where, with
relation to a certain person, considered in the character of a Ward, a
certain other person does not, according to law, stand
in the condition of a Guardian, [nor does according
to Law stand bound to take upon himself that condition,]
a certain third person (the delinquent) by
some unlawful act, positive or negative, causes, or
contributes to cause, such falsely supposed Guardian
against his will to place himself, or to be placed in that same condition,
and to be in respect of law regarded and dealt
with as if he were lawfully so placed. —
