Ch. X. Offences appg title to condition
§.8 Wrongful self exoneration

6. Wrongful abdication of Mastership is where,
with a relation to a certain person considered
in the character of a Servant, a certain
person (the delinquent) being placed by law(1) in
the condition of a Master, and in respect
thereof subjected to certain obligations, exercises
some unlawful act(2) positive or negative, Act, having for its effect or object
the causing it to be believed, that he does himself to be regarded and dealt with
is by law, as if he were not in possession of such condition
with relation to such supposed Servant
And in consequence that he does not stand was accordingly not
subject to any such obligations.

☞ Example of its occasion – being called upon to pay a tax
in respect of such supposed account, as to credit it be
his maintenance

(1) [Placed by law] viz. by his having a title to the possession
of such condition and in virtue of such title however exercised
the powers or rights thereto attended by law. For the titles in question
see Non-penal Code Law of Masters and Servants.

Not having necessarily and in the nature of the case, obligations
in any shape annext to it, this condition, it might
at first sight be supposed, is not capable of being taken for the subject of Wrongful
abdication. But by accident it may happen to it to be
subjected by law to obligation of an in various sorts classes: for instance to
the payment of a tax; as is present under English law. 2. In all no civilized country as the condition of a Master supposed to have
place without having obligations attached to it for the benefit of the Servant.
