Penal Code

§ 2 / 3 or 4. Instruments of the evil produced by delinquency

Instruments of delinquency-begotten evil.
These are I. Faculty applied to, the evil volitions or say the will.
I. Matter applied the matter of good (Mode of application)
1. Physical Coercion physical: that is being compulsion or restraint or say restraint. 2. Internal Coercion mental: 1. compulsion or restraint produced by
intimidation: the matter applied in the shape of matter of punishment.
3. Matter applied – the matter of good.
3. Allection or say allurement: the matter applied in the shape
of matter of remuneration or say reward or say of remuneration.

II. Faculty applied to, the intellectual, or say the understanding
4. Deception.

Instruments of deception are
1. Fallacious statements representation
2. Fallacious arguments: i.e. inference drawn from the alledged facts
credence of which is has been produced by statements true
or false or true.

I. Instruments of deception by false statements fallacious representation

1. Mendacity representation mendacity or say mendacity the mind contained
of the falsity of those conceptions what is as true i.e. as existi agreeing with the actual state of things.

2. Representation false and temerarious: not mendacious because
no evil consciousness has place: no persuasion of the falsity of
that which it represents as true, no persuasion of that disagreement
which actually has place, the cause of the disagreement
being no other than the absence of a that degree of closeness of attention which
would have been necessary to secure the above-mentioned agreement.

3. Perjury has place where to secure the agreement below the state
of things as really existent and the state of things as represented
the ceremony act called swearing has been employed, swearing
is say taking an oath acting a part in a ceremony
so called.

4. Personation. This is mendacity applied to the purpose
of producing a belief or say persuasion in affirmative of
whereby persons at be seen on the occasion of which the endeavour is to cause persons in a cause to believe
a one certain person to be a person another different one.

5. Forgery. This is mendacity, whether expressed by words
language or deportment, employed in the endeavours to cause some
person or persons to believe in relation to a certain portion of the
matter of discourse that it the discourse it extracted was on the
occasion in question the discourse of some person or persons other than his
or those whose discourse it were made is.
