Penal Code

N.B. Of all these several instruments those exhibited in the
character of instruments of evil – of evil in the shape of delinquency
– in a word of delinquency, not one of them is there that is absolutely
incapable of being employed, and operating, as an instrument of good.

In particular coercion physical in both its modes forms and coercion
mental in both its forms are instruments necessary and
indispensable instruments in the hand of the legislator.

So likewise is or say allurement – application made
of the matter of good in the character of matters of reward to the purposes
of giving direction to human conduct.

Nor yet is deception – nor therefore any or few abovementioned
instruments of deception altogether altogether necessarily of being made to produce
such quantity of good as in the individual instance in question shall be preponderant over the quantity
of good evil produced by it: witness the case where it is employed
applied to the purpose of preventing an incidence from
or a criminal from the committing a mischievious act.

But in every case in which no such extraordinary
good is produced by the use of those instruments they are instruments
of evil, and except as above to the production of evil in every shape they are in
by the nature of things an and degree adequate.

Proportionate to the degree of their tendency thus to operate
is the of the and endeavour which it belongs becomes to the legislator to
direct to the prevention of them.

Inconsiderable will be found to be the of which is liable to become the instrument, in comparison of that which is liable to become the instrument.
