8. Extenuations. Circumstances operating on diminution
of the evil of the offence, and thence in the quantity of the
matter of demand for the punishment and satisfaction and for the diminution of
that same evil.
Examples are as follows.
1. Belief more or less of the existence of a legitimate cause of justification
2. Provocation real or say actually received wrong received at the by the defendant at the
hands of the prisoner to a party in whose favour satisfaction
is demanded by the suit.
3. Provocation not actually so given received but believed by the defen. to have been so
given.
4. Immaturity of age.
Ratiocinative
Art. Reason in which the giving to the circumstance
in question the effect in question of an extenuation and thence of
a satisfaction-lessening and punishment lessening circumstance.
1. The quantum of the evil of the second order reduces.
2. So of the Evil of the third order.
Instructional
Art. Uses of the matter belonging to this head
1. Preserving functionaries and right-holder from being, on account of exercise given
to their respective function, and private power holders and right-holders
from being dealt with on the footing of delinquents, where
the degree of delinquency is not great enough to warrant or necessitate
or warrant their being so dealt with or where it is great enough for
that purpose securing them from being subjected to a weight of burthen
greater than the exigency of the case calls for
2. Preserving persons at large from the pressure of the like burthen
in so far as not needed as it fails of being needed.
