Medical practice
where not superseded
(as a justification) by
consent

Justifications second. medical practice. In
most cases, the ground of justification denominated
medical practice, will be included in or the demand
for it superseded by, consent. But there are some
cases, in which this observation will not hold
good.

Case 1 Patient insensible
and cannot
consent
Case 1. The patient not in a condition capable
of giving consent: as for instance, in a case of fainting
or insensibility produced by any other cause.

Case 2 Patient too
young to give his
consent to be
necessary
Case 2. The patient not arrived at the age
at which his consent could be regarded as necessary.
In this case, the consent of the parent or other guardian,
will be to be received as sufficient

Case 3. The consent obtained by the
medical practitioner, with benevolent intentions but
on knowingly false statements. It might be giving
to great a probability of success to preponderantly mischievous
falsehood, if in a case of this sort, the medical
practitioner more of exonerated, from all responsibility
