In self preservation
is included self defence

Included under the idea of self preservation is
self defence. Whether there will be any use in constituting
it a separate head, will be matter for consideration.
Self defence, in the case of a defence affecting
the body is the endeavour at self preservation
at the instant from an evil, endeavoured
to be produced at that same instant, by the
person against whose accusation, as for wrong
in this shape, the circumstance in question is
proposed to operate in the character of a justification.
This being the simplest case that can
be proposed, there may be an advantage in
taking it into consideration in the first instance,
and when its to be admitted to operate
in this character have been , then might be
the time to give extension to the survey, and
to consider what might be the effect of other circumstances,
which give a greater degree of complexity
to the case.
