Ld Bacon's case Two
men on a plank capable
of saving only one
One pushes the other
off punishment here
would be of no avail.
Lord Bacon states a case which will be a
fair standard of comparison of in as much as
the groundless of punishment in a case is made evident
by it. Two men are upon a plank, which is
capable of saving but one: one of the two pushes his
fellow off. In this case, punishment less than
death would be of no avail in preventing a like
offence — nor would the punishment of death, unless
it were made more certain and more near
that which he escapes by thrusting his fellow into the
sea. No man would apprehend more from the individual
who does this, than from any other individual.
