Penal Code
Ch.
§.
16
At any rate not
extendable to disablement
disfigurement
mutilation nor homicide
One observation there is, however, which may
without impropriety be placed under the present
head. This is that, neither to disfigurement,
disablement, mutilation nor homicide can
this efficient cause of justification be applicable.
One case alone can present itself as presenting my
demand for this protection; the and that is, the case
of infanticide. But of this, under a special head.
17
As to morbification
transient may
be justifiable — not
so permanent.
As to morbification a distinction must be
made between transient and permanent.
If transient alone be considered, justification may
be afforded, by other or both of two of the preceding
proposed causes — to wit, domestick authority &
medical practice. It has place as often as by
the father, or in quality of conjunct-guardian by
the mother, or in quality of temporary
guardian, by a nurse or boardg school master or mistress is administered
to a child.
