Scale of accessory evils
to be attached to every
denomination of offence

To give full effect to the rule here in question, a
scale of accessory evils, with their correspondent gradations
of punishment will be to be attached to every denomination
of offence.

Rule of proportionality
to be observed in
employment of means
of repression

Supposing for arguments sake, that a set of
gradations distinctions thus particular & a scale of gradations
thus numerous — gradations as to the magnitude of
the punishment could not be provided, still the distinctions
might in some other way, be turned to use: in certain
of these cases for example might be employed, other
means of repression over and above those employed in
certain others of these same cases.

If imprisonment for life with or without forced
labour & other additions be attached to completely &
intentionally predatory homicide without warning this might be
taken as the highest point in the scale of punishment. The others
which have been exemplified together with such as remain to be
added might be placed under it as so many inferior degrees.
