Menacement
what
8. Menacement is where, by the act of one
person, for the purpose of producing action
a forbearance in any shape, on the part of
another, an apprehension is produced or
endeavoured to be produced in the mind the mind
of the party menaced on the part of the menacee,
that, in case of non compliance,
will, by the act of the menacer, be made to fall upon him
in some shape, in which, the menacer will
not on that occasion have the right so to
inflict it; or say, be warranted in law
so to inflict it no matter by what means or
the apprehension in question be produced or
endeavoured to be produced: whether by
discourse, oral or written, by gesture, deportment
or even countenance; so that the
intention be sufficiently expressed to be productive
or likely to be productive of the effect
